ACCEPTANCE OF TERMS THROUGH USE
This pages outlines the terms and conditions under which you, the Advertiser/ user, may use this site. You signify your agreement to all terms and conditions of use of this site by using this site. If you do not agree to these Terms of Use please do not use this site. Baile Property Services Limited reserve the right to update or revise these Terms of Use. We reserve the right to do this at any time of our chosing. Please check the Terms of Use periodically for changes. Your continued use of this site following the posting of any changes to the Terms of Use constitutes acceptance of those changes.

Law relating to this site
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Ireland and the parties hereto submit to the jurisdiction of the Courts of the Republic of Ireland.
SEVERABILITY
If any provision of these terms and conditions shall be found by a court or as a result of any Statute or Government Order or otherwise to be invalid or unenforceable the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms and Conditions and all provisions not affected shall remain in force. The rights of you the user are assured through Regulation 6 of the European Communities unfair terms and conditions act 1995.
INDEMNIFICATION
You the Advertiser/User herby agree to indemnify, keep indemnified and hold harmless Baile Property Services Limited its, employees, servants, agents, contractors, officers, directors and assigns from and against all liability, claims and expenses including legal costs arising or bought against the company either as a direct or indirect result of your use or misuse of this site.
Without prejudice to the foregoing, Baile Property Services Limited reserves the right, at its own expense to assume the exclusive defence and control of any matter otherwise subject to indemnification by you. In these circumstances, you agree to fully co-operate with Baile Property Services Limited in relation to any claims, proceedings, judicial or otherwise, and litigation of any kind.
DISPUTES
Any dispute or difference of any kind whatsoever which may arise between you the advertiser/user and Baile Property Services Limited shall be referred to a single arbitrator to be agreed between the parties or, in the absence of agreement, to be named by the Director of Corporate Affairs for the time being. The arbitrator from time to time acting under this provision shall have and may exercise all the powers conferred on arbitrators by the arbitration Act 1954 or any statutory modification thereof. An award in such arbitration shall be a condition precedent to any legal proceedings in any court against Baile Property Services Limited in respect of such dispute or difference.

Content of Users Posting
All ads and articles posted on this site by you the Advertiser/User must conform to the current edition advertising Authority of Ireland codes of practice, European Standards (For example - Section 8 of the European Communities Regulations 1988 on misleading Advertising) and Current law. In Particular you must NOT do the following:
- Post material which is contrary to the intended use of this website.
- Post false, misleading, incorrect, inaccurate or un-reliable information.
- Post material the content of which breaches criminal law.
- Post sexually explicit images or material.
- Post any material that is capable of breaching any copyright, trademark or other proprietary rights of any third party under Irish and Foreign Law.
- Post any material, which could be considered sensitive or prejudicial to the proprietary interests of any third party including but not limited to their trade secrets.
- Post any Material, which is threatening, obscene, hateful, spiteful, embarrassing, and abusive or which invades on privacy or rights of others.
- Post any material, which is or is capable of being defamatory or damaging to the good name or reputation of any other person or company.
- Post any material or information in relation to any person or property, which the advertiser/user knows or ought to have known are the subject of on going or threatened legal proceedings.
- Commit any act or omission, make any statement or publish any material, which is capable of harming the legitimate interests of the owners of this website or the business of Baile Property Limited Services in any way.
Baile Property Services Limited will not be and is not responsible for scanning any or all ads and articles.
If in the opinion of Baile Property Services Limited any of the ads or articles posted on this site, do not conform with the above terms and conditions or are contrary to the said terms and conditions in any way, Baile Property Services Limited reserve the right, at its own discretion to remove such material from the site without prior notice to the Advertiser/User.
In such circumstances and with immediate effect, Baile Property Services Limited will expel Advertisers/Users and bar them from future use of this site. For the avoidance of doubt, the contract shall be deemed to be terminated due to an act of default by the Advertiser/User and all monies paid to date shall be forfeited to the Baile Property Services Limited.

PROVISION OF SERVICES
In order to use the Services of Baile Property Services Limited, you, the Advertiser/User must first agree to these terms and conditions. If you are not happy with them please do not use this website.
Use of this website and in particular completion of registration / placing ads and adverts is deemed to be acceptance of these terms and conditions.
All services provided must be paid for in full before ads or articles will be activated. There may be an exception to the foregoing in relation to special promotions or free ads / articles. Baile Property Services Limited hereby agrees and are bound to activate all ads as soon as is practicable after payment in full has been received and terms and conditions accepted.
Payment in full shall not be deemed to take place until :
- In the case of credit card payments once payment is cleared by the Baile Property Services Limited Bank.
- In the case of bank draft or postal order, the date of receipt.
- In the case of cheque once check is cleared by the Baile Property Services Limited Bank.
- In the case of standing order once payment is cleared by the Baile Property Services Limited Bank.
- In the case of cash, the date of receipt.
- In the case of electronic transfer, once payment is received by the Baile Property Services Limited Bank.
Baile Property Services Limited may at its own discretion and in certain cases, activate ads or articles prior to receipt of payment. However in the event of a payment being rejected for any reason, all ads and articles will be de-activated without further notice to the User/Advertiser.

By Posting data on the site you the Advertiser/User give Baile Property Services Limited the right to reproduce, use, modify, edit, publish, distribute, promote and display the content in any form or media.
Advertiser's/User's are not required to fill in or complete any or all of our requests for information but failure to do so may lead to the inability of the User/Advertiser to use this website.
